CONDITIONS OF USE AND CONTRACTING SHIPPING INFORMATION

1.- Location

All shipments leave our warehouse located in Montornés del Vallés, Barcelona, and from there they are distributed to any point in Spain. All shipments include the corresponding Spanish VAT.

2.- Preparation

Shipments are prepared (except for special circumstances) until 5:00 p.m. from Monday to Friday. Orders that are placed before 9:00 in the morning will be prepared and shipped the same day if possible (with exceptions and including breakage or end of stock), and the customer will receive them in 2 to 5 business days. In the case of orders placed after this time, the order will be shipped the next day. These conditions only apply to orders whose payment is made by credit card.

The delivery service we use is of type 2 to 5 business days. This means that the delivery to our customers is made during the hours after leaving our warehouse. No deliveries are made on Saturdays or holidays, so orders placed on Friday will be processed on Monday.

3.- Delivery schedule

Deliveries will be made between 9am and 5pm. Transport companies never specify the exact time of delivery, and therefore it is recommended that you provide an address where there may be someone to pick up the order within this time frame.

If requested, the possibility of tracking the order (via the web) will be made available to the client in order to organize its reception in the best possible way.

If you do not want the order to be delivered within those 2 to 5 days, notify it in the additional information section. Whenever the client specifies a specific delivery time, CLB Forklifts includes it on the delivery note, although the transport companies are not obliged to comply with it (but they do try as much as possible to ensure delivery).

If the carrier cannot deliver the package due to not finding anyone, it will return to the carrier's warehouse in the destination city. They will try to contact the customer the next day to arrange a new delivery, so it is very important that they leave us a valid phone number where they can be contacted. 4.- Shipping cost

The cost of shipping the accessories is included in the purchase price for delivery to the peninsula. (Shipments outside the peninsula send an inquiry to the email info@cl-bcn.com.

There is the possibility of collecting the merchandise by our facilities, informing before its collection. In this case the cost of transport will be paid.

For machinery (weighing more than 150kg), it will have to be agreed in advance whether we organize the shipment or, on the contrary, the buyer organizes the collection at our facilities.

In case of organizing the shipment, we would always inform the cost of the service beforehand.

GENERAL CONDITIONS

Before buying products through the CLB Forklifts website, it is important that you carefully read and understand these conditions, since by formalizing the order they are automatically accepted.

The products offered on this website are managed by CLB Forklifts. CLB Forklifts sells to the customer and the customer purchases the product(s) specified in the order. The highs and lows in our stock are updated daily. In the case of requesting an out of stock product, we will proceed to inform you through the email address you have provided us.

The conditions and prices shown on the website are valid except for typographical errors. Prices are reviewed periodically, and are subject to change without notice. At the time of completing the order you will be informed of the final costs of your order.

If you need or want to propose another shipping method different from the one shown on the website, please contact us before placing your order.

We will try to make the website accessible 24 hours a day. CLB Forklifts is not responsible if the website is inaccessible at any time or for any period of time. The connection may be temporarily suspended in the event of system failure, maintenance or repair, as well as any other circumstances beyond our control.

The website will remain open to consult the products, but purchases cannot be made during the holiday periods. An attempt will be made to indicate the duration and dates of these periods sufficiently in advance.

Payment Methods:

You can make your purchases with the following forms of payment:

- Credit or debit card

All payments made by credit card on the web are processed by Stripe, the fastest, most secure and most advanced platform in the sector. CLB Forklifts accepts payments with VISA, Verified by VISA, MasterCard and MasterCard SecureCode.

- Wire transfer.

Orders made by transfer will have a validity of 3 business days to send us proof of payment. After 3 calendar days, the order will be canceled and without the right to price reservation as it is understood that the customer does not want the purchase.

- Cash in our facilities.

Payment in cash can be made at our facilities only for purchases of less than €1,000.

Partial payments in cash will not be accepted for invoices whose tax base is greater than €1,000.

Money refunds:

At CLB Forklifts, returns and exchanges will be made by bank transfer to an account of the same owner and attaching a certificate of bank ownership for greater security.

Cancellation of the order:

Orders can only be canceled before they are delivered to the transport company at no cost. Otherwise the cost of transport will not be returned.

It is convenient that the cancellation of the order be made as soon as possible and by telephone. CLB Forklift tries to work with agility and therefore, if it is done by email, it will be the customer's responsibility if the order has been delivered to the transport, without having previously seen the email communication.

Incidents during shipment:

Impact and/or breakage: In the unlikely event that the package will reach your hands with visible damage or in poor condition, please state this on the delivery note that you must sign for the carrier (if possible, photograph the defective merchandise at your reception and report as quickly as possible). Accept the shipment and send us an email with the incident to info@cl-bcn.com, otherwise it will be difficult to file a subsequent claim with the transport company if the content is damaged.

Loss: If a shipment is lost, CLB Forklifts will proceed with its claim without any cost or need for management by the customer.

Delay: In the case of unjustified delay in the delivery of a package, the client must notify CLB Forklifts so that we can proceed with the corresponding claim. Currently, transport companies rarely cover the cost of shipping, but if compensation can be obtained, CLB Forklifts will inform the customer. CLB Forklifts will not compensate customers for delays caused by delivery delays caused by transportation.

In the event that the client rejects the delivery of the package: If the client rejects the delivery, regardless of the nature of the reason, without prior authorization or express consent by CLB Forklifts, CLB Forklifts reserves the right and may unilaterally decide the solution to pay the customer the amount of the purchase minus the costs of the actual transport generated or a new delivery of the merchandise since the merchandise was sent. This decision will not be subject to the customer's consent, since a breach of contract by the customer will be understood as any rejection of any delivery attempt.

APPLICABLE LEGISLATION AND JURISDICTIONAL COMPETENCE

This Legal Notice is governed by current Spanish regulations that apply to it.

For the resolution of disputes that may arise as a result of the provisions of these provisions and their interpretation, application and compliance. The user, by virtue of accepting the conditions contained in this Legal Notice, expressly waives any other jurisdiction that may correspond to him.

In any case, within the Spanish jurisdiction, if the legislation allows submitting to a specific jurisdiction, the user expressly waives the jurisdiction that may correspond to him and voluntarily submits to the jurisdiction of the Courts and Tribunals of Barcelona.

CLB Forklifts - RETURN AND WITHDRAWAL POLICY:

CLB Forklifts will accept returns of products that are unused, in perfect condition, clean, and if possible with their packaging and without traces of manipulation that do not generate a depreciation of the value of the product more than what is necessary to verify its nature and function, For this reason, the payment or exchange will not be made until the merchandise is received at our facilities. If upon receipt of the package it does not meet these conditions, the return will not be accepted.

The client has the right to withdraw from this contract within a period of 07 calendar days without the need for justification. The withdrawal period will expire 07 calendar days from the day that you or a third party indicated by you, other than the carrier, acquired material possession of the goods.

If for some reason this period is not possible, it is necessary to notify when placing the order so that we can approve different conditions. Once the period of 07 calendar days has expired, CLB Forklifts will not accept returns for withdrawal of product purchases. In accordance with the provisions of Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of consumers and users and other complementary laws, approved by Royal Legislative Decree 1/ 2007 of November 16).

To exercise the right of withdrawal, you must notify us: CLB Forklifts, SL, info@cl-bcn.com your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post, or email) .

To comply with the withdrawal period, it is sufficient that the communication regarding the exercise by you of this right is sent before the corresponding period expires.

Special or personalized orders are not entitled to and their return and withdrawal are excluded, except for reasons of manufacturing defects. In special or personalized orders, the following clause will be considered included:

* Special orders are considered to be the supply of goods made according to the specifications of the client/user clearly personalized, by email or by telephone, whose specifications are different from the products usually in stock in our web catalog.

RETURN CONDITIONS

We accept all returns that meet these requirements:

* You can request a return within 07 days of purchase.

* The article must be in the same conditions with which it was delivered.    In addition, items must arrive at CLB Forklifts protected and properly packaged to prevent damage during return shipping.

* It must be properly packed so as not to be damaged or damaged during return transport. In case of non-compliance, your return cannot be accepted or the amount of the estimated damages may be subtracted from the payment. The client will be responsible for the decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.

* Return shipping costs are borne by the customer. It is calculated that this cost could amount to an estimated amount between €0 and €800 depending on the volume and weight of the product and the transport agency you choose.

* In case of withdrawal on your part, we will return all payments received from you minus transport costs, without undue delay and, in any case, no later than 07 calendar days from the date of receipt of the material in our facilities. .

* Once we receive the item and verify that its condition is correct, we will refund the amount via transfer, subtracting the amounts mentioned and paying the pending differential. In the event that CLB Forklifts decides to accept, at the request of the client, manage the return of the product with the transport agency, the client will be previously informed of the costs and amounts that will be paid by the client.

* If at the time the customer receives a product it is broken or defective,  CLB Forklifts reserves the right to decide to return the amount paid or replace it with one in the same conditions.

* In the event that the defect appears later, the case will be studied according to the Guarantee and Returns regulations and the steps stipulated will be followed.

In the event that the requirements are not met or any type of damage/defect/use of the product is observed, CLB Forklifts maintains the right not to accept the return or to subtract from the payment the amount of the estimated damages together with the transport costs.

It is essential to notify CLB Forklifts before returning any product so that there are no problems during processing and that our team can control the receipt of the material.

GUARANTEES AND RESPONSIBILITIES

New products

1. The client, once the delivery of the products has been made, must  always verify a correct, adequate and good faith use of these; and, in this sense, it must have subscribed and keep in force the civil liability and damage insurance that it must have contracted in the framework of its activities.

2. The client will have the benefits of a guarantee for defects granted by 

     CLB Forklifts, which will be valid for 365 days from the date of   

     delivery of the product; or the first 1,000 hours of use, whichever 

     comes first.

3. Excluded from the warranty referred to in section 2. above are defects 

    arising from lack of preventive maintenance, or due to negligence in 

    the use or handling of the products. Also excluded are elements 

    subject to wear, such as contacts, brushes, fuses, lubricants, wheels,

    among others. Likewise, problems arising in batteries, chargers and/

    or new accessories are excluded from the CLB Forklifts guarantee, 

    corresponding to the manufacturer brand.

4. If the existence of a defect is verified in the aforementioned terms, the 

    client will notify CLB Forklifts, no later than 7 business days after 

    becoming aware of its existence.

5. Due to the geographical breadth, the client accepts that the guarantee 

    offered in the new products will be carried out in our facilities in 

    Montornes del Valles, Barcelona, not including the transport costs 

    derived from the transfer of the products to our facilities and return to 

    the client.

6. CLB Forklifts reserves the right to substitute a product for another of 

    the same characteristics whenever it is available.

7. New products will lose all warranty if they have undergone 

    modifications or improper use and different from that indicated by the 

    manufacturer.

Used Products

1. The client, once the delivery of the products has been made, must always verify a correct, adequate and good faith use of these; and, in this sense, it must have subscribed and keep in force the civil liability and damage insurance that it must have contracted in the framework of its activities.

2. The client will have the benefits of a guarantee for defects in 

     operation granted by CLB Forklifts, which will be valid for 3 months 

     from the date of delivery of the product; or the first 300 hours of use, 

     whichever comes first.

3. Second-hand machinery may have defects in covers, plastics, paint, 

    wheels, seats that do not prevent its proper functioning, leaving these 

    exempt from the guarantee. The client will receive photographs of the 

    real state of the machine accepting the conditions and state of the 

    same as can be seen in the photographs published on this web page.

4. Nor will parts or elements with wear that adjusts to the number of

    hours worked by the machine, such as joints, springs, brakes, 

    bushings, chains, etc., be covered by the guarantee. The buyer will 

    always be informed of the working hours of each machine in its file on 

    this website.

5. Traction batteries will not be guaranteed as long as their status is less 

     than 80% in the discharge test (C5) that we can carry out in our 

     facilities. The customer will be informed and will assume the risk of 

     poor performance of the batteries below 80% in the discharge test 

     (C5). The possibility of installing a brand new battery will always be 

    offered for an additional cost visible in the observations on the sheet 

    of each machine. New batteries installed in second-hand machines 

    will have the New Product guarantee.

6. Due to the geographical scope of the different clients, the guarantee 

    will be offered at our facilities in Montornes del Valles, Barcelona, not 

    including transport or travel.

7. All machines will lose all guarantee if they have undergone 

    modifications or improper use and different from that indicated by the 

    manufacturer.
